Terms of service

1. Who we are

Zwovo has its registered office at Hristo Smirnenski 20, Dobrinishte, Bulgaria (not open to visitors). In these terms we call ourselves "Zwovo" or "we". You can reach us at help@zwovo.com.

2. Definitions

• You: the business owner or organisation that takes out a subscription with Zwovo.
• Website: the website we make for you and keep online.
• Dashboard: the secure area where you manage your website, ask for changes and manage your subscription.
• Plan: Start, Pro or Studio, as described on zwovo.com at the moment you order.
• Subscription: the agreement between you and Zwovo for a plan.

3. Who Zwovo is for

Zwovo is meant for businesses and organisations. You take out the subscription for your business, profession or organisation. You are at least 18 years old and authorised to enter into the agreement.

If you nevertheless take out the subscription as a consumer, you keep every right the law of your country of residence gives you. Where these terms conflict with that law, the law prevails.

4. What you get

What each plan includes is described on zwovo.com. Every plan includes at least: a website we make for you, hosting, a secure connection (SSL) and access to your dashboard.

• Free preview. The preview on zwovo.com is without obligation. It is not an offer you can derive rights from, and it may differ from the final website.
• Texts written by AI. On Start and Pro, artificial intelligence writes the texts, based on what you tell us about your business. Check them before you use them. We do not guarantee that they are free of errors or complete; you decide what goes on your website.
• Small changes. In your dashboard you ask for changes in your own words. Small changes, such as opening hours or a price, are free up to 10 a month.
• Revisions. A revision is a larger rework of your texts or style. Start includes 2 and Pro includes 3. After that a revision costs €10, or the amount shown in your dashboard at that time.
• Messages and appointments. Visitors can send you a message and ask for an appointment through your website. On Pro and Studio they can also book a free time in your agenda themselves. Everything appears in your dashboard, and we send an email about it to you and, for an appointment, to your customer. An email can be delayed or fail to arrive; what is in your dashboard is what counts. Keeping your appointments is your own responsibility.
• Google reviews. On Pro and Studio you can show your Google rating on your website. We show your average rating and the reviews Google gives us, in Google's order. We do not leave out reviews because they are less favourable.
• Studio. On Studio our designers build your website to measure and make your changes for you. We aim to have a first version online within 48 hours after we have received everything from you. That is a target, not a guarantee.
• Custom work. For larger projects we make a separate proposal. What it says takes precedence over these terms.

We may change and improve the service. If we remove something you materially rely on, we tell you at least 30 days in advance and you may cancel.

5. Term and cancelling

Your subscription starts as soon as your first payment has succeeded. It runs per month and renews automatically every month until you cancel.

You cancel in your dashboard, at any time and without a notice period. Your website stays online until the end of the month you have already paid for and then goes offline. You do not get a refund for the remainder of that month, except under article 7.

After your subscription ends we keep your website for at least 90 days, so you can put it back online. After that we may delete it.

6. Prices and payment

• The prices are on zwovo.com and include VAT. You see the amount you pay before you check out.
• You pay monthly in advance. Payment runs through Stripe; by ordering you authorise us to collect the monthly amount automatically.
• An introductory price, such as €10 for the first month on Start, applies only to the first month of your first subscription.
• If a payment fails we try again and let you know. If it is still unpaid after 3 days, we may take your website offline until the payment has arrived.
• We may change our prices. We tell you by email at least 30 days in advance. If you do not agree, you cancel before the new price takes effect.
• You receive invoices by email or find them through your dashboard.

7. Money back

Within 14 days of your first payment you can stop without giving a reason and get your money back. Send an email to help@zwovo.com from the address you ordered with. We refund the subscription amount you paid within 14 days, the same way you paid, and take your website offline.

This applies once per customer. It does not apply to a domain name that has already been registered for you, or to paid revisions that have already been carried out: those costs have then already been incurred.

If you are a consumer you also have the statutory right to withdraw from the agreement within 14 days. By ordering you ask us to start straight away; if you withdraw after that, we may charge pro rata for the days your website was online. Under the arrangement above you simply get the full amount back in practice.

8. Domain names

• You can connect a domain name you already own. You then change the settings at your provider yourself; your dashboard shows what to enter.
• You can also register a domain name through us. It is registered in your name and remains yours. To do so we pass your contact details to the registry. The registry's rules apply as well.
• You pay for a domain name yearly in advance. It renews automatically every year until you cancel it in your dashboard. A domain name that has been registered or renewed cannot be cancelled or refunded.
• Pro and Studio include one domain name for as long as your subscription runs. If you cancel your subscription we stop renewing that domain name. You can transfer it to another provider.

9. Your content and your responsibility

You are responsible for everything on your website, including texts that we or our AI wrote for you. You make sure that:

• the details you give us are correct, and you update them when they change;
• you are allowed to use the photos, logos and texts you supply;
• your website meets the rules that apply to your business, such as stating your company details and prices, and having your own privacy notice if you need one;
• you use the details of visitors who send a message or make an appointment through your website only to answer them and manage your appointments, and not for advertising without their consent;
• it contains nothing that is unlawful, misleading, discriminatory, threatening or harmful, or that infringes the rights of others.

If we receive a complaint about your website, or see that it breaches these terms or the law, we may change or remove content or take your website offline. We let you know as soon as possible. You indemnify us against claims by others about content you supplied or approved.

You do not use Zwovo to send spam, to disrupt or circumvent our systems, or to resell websites to others unless we have agreed to that.

10. Who owns what

• Yours. The texts, photos, logos and details you supply remain yours. You give us the right to use them to make and show your website. We make no claim to texts written for your website; you may use those freely.
• Zwovo's. The design, templates, software and technology behind your website remain Zwovo's. You get the right to use them for as long as your subscription runs. You cannot export the website or take it to another provider.
• Photos from our library. Photos we place on your website may only be used on your Zwovo website.
• Your domain name. A domain name registered in your name remains yours, also when you cancel.

At the bottom of your website there is a small "Website by Zwovo" credit.

11. Availability and maintenance

We do our best to keep your website reachable at all times, but we cannot guarantee that it will be without interruption. Maintenance is sometimes needed; where possible we plan it at quiet times. We make regular backups and secure our systems in a way that fits the service.

12. Liability

• Our liability is limited to the amount you paid for your subscription in the 12 months before the damage.
• We are not liable for indirect damage, such as lost revenue, lost customers or lost data.
• We are not liable if we cannot meet our obligations because of something beyond our control, such as an outage at a supplier or network.
• These limits do not apply in case of intent or gross negligence on our part, nor to the extent the law does not allow a limitation.
• Report damage within 2 months after you discover it, at help@zwovo.com.

13. When we may stop

We may suspend or end your subscription if you do not pay, if you seriously or repeatedly breach these terms, or if the law requires us to. If we stop Zwovo or your plan ourselves, we tell you at least 30 days in advance and refund what you paid in advance for the period after that.

14. Privacy

How we handle personal data is set out in our privacy statement. The data processing agreement applies to the personal data of visitors to your website that we process on your behalf. It forms part of these terms.

15. Changes to these terms

We may change these terms. We tell you by email at least 30 days in advance about a change that is to your disadvantage. If you do not agree, you cancel before the change takes effect. If you remain a customer after that, the new terms apply.

16. Governing law and disputes

This agreement is governed by Bulgarian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live.

Do you have a complaint? Email us at help@zwovo.com; we reply within 5 working days and look for a solution together. If we cannot resolve it, the court at Zwovo's registered office has jurisdiction. If you are a consumer, you may also go to the court where you live.

17. Finally

If a provision of these terms is invalid, the other provisions remain in force. These terms exist in Dutch and English; where they differ, the version in the language you ordered in applies.
